The Forces Pension Society (FPS) are pleased to offer a complete and comprehensive Wills and Probate Service for their Members and families, where they can receive free advice on the duties and responsibilities of an executor when someone dies or information concerning the preparation of their Will(s). This service is managed by King’s Court Trust Corporation plc (Probate and Estate Administration) and Steele Rose & Co Limited (Wills and Estate Planning).

Probate and Estate Administration

Probate may be an unfamiliar and complicated procedure faced at a distressing time.

Executors are responsible for applying for the Grant of Probate, administering the estate and distributing the assets. To ensure that this is carried out in accordance with the complex rules of Probate, it is normal to appoint a professional firm.

The Forces Pension Society provides a specialist Probate and Estate Administration managed by King’s Court Trust Corporation Plc. This service is for executors and for the personal representatives of those who die intestate. The Service ensures that Probate is granted efficiently, assets are distributed quickly and trusts are handled effectively.

The Service will relieve you of the stress involved and will manage the complex work of administration on your behalf, as well as releasing you from your personal liability as executor.

Wills and Estate Planning

Estate conjures up a grand house and hundreds of acres. In reality, on death everyone leaves an estate - what is left after any bills are paid.

What happens to your estate depends on your will - a legal document that:

 

Records wishes about funeral arrangements

Appoints people to deal with the estate - the executors

Nominates guardians for any minor children

Specifies any gifts for people and charities

States how the remainder is to be distributed

Names beneficiaries

Your Will can also be used to reduce Inheritance Tax, levied at 40% on chargeable estates above the Nil Rate Band threshold. This concession has not kept pace with rises in property values. Many more people will therefore be liable for the tax, especially on the second death in an unmarried couple, unless special trust clauses are included in their Wills.Trusts can also protect your family from long term care fees.

If you have no Will, the laws of intestacy will determine who is to administer your estate and how it is to be distributed. This is unlikely to match either the requirements of the survivors or the wishes of the deceased. Whether young, old, single, co-habiting, married, divorced, widowed, wealthy or not so well off it is better and more responsible to have an up to date Will.

Did you know?

Many veterans could benefit from a little known inheritance tax (IHT) exemption. If your death is a result of injuries or illness sustained on active service, your estate should not be subject to IHT.

This rule applies even if the death occurs years after the injuries were sustained and could apply now and in the future, including Gulf War veterans and those who have been injured in Iraq, Afghanistan or Bosnia.

In many cases involving the world wars, medical evidence may be lost, so veterans should prepare a detailed statement of wounds or diseases, Keep this statement updated and alert your family doctor. It is also important to ensure that the death certificate records all causes of death.
